Renee Jefferson Smith, who recently finished third in the race for District B seat on Houston city council, has filed a lawsuit against her opponent. She seeks the removal of the second-place finisher Cynthia Bailey from the ballot. She said in her appeal that Cynthia was convicted for theft of over $200,000. Such conviction makes her ineligible to appear on the ballot.
According to the Texas Election Code, the candidate should not have been finally convicted in any crime to appear on the ballot. In the lawsuit, Renee argued that Bailey didn't provide the correct information in her filing papers about her conviction. However, the felony records have reached the ballot in Houston, Austin, and San Antonio in the past, as well as the law, which has not been appropriately implemented.
